SC dismisses plea seeking directions to GOI to move ICJ claiming $600 Billion Dollars damages from China for spreading COVID19 as Bioweapon
NEW DELHI, 18 June 2020: The Supreme Court of India on Thursday 18 June 2020 dismissed a petition praying for a direction to the Government of India - Union Ministry of Social Justice, Ministry of Health and Family Welfare, and Ministry of Law and Justice to move to the International Court of Justice claiming for 600 billion US dollars in damages from the People's Republic of China for spreading the COVID-19 pandemic.
The Supreme Court bench of Chief Justice SA Bobde, Justices AS Bopanna & Dinesh Maheshwari refused to entertain the plea but asked the petitioner to make representation before the appropriate authority.
The petition filed by Madurai resident K K Ramesh pointed out that many countries and its leaders have openly expressed their view that China created a biological weapon of COVID-19, which was not originated from animals. America's president also said that he did have evidence of COVID-19 pandemic was created in a biological lab in China, it claimed.
The petition filed by advocate C R Jaya Sukin contended that the Wuhan Institute of Virology had been used for China’s illegal biological warfare weapon program.
The petition contending that the Corona Virus has deliberately created as a biological weapon by the People's Republic of China to be leaked into public places and was used as a bioweapon by China against India in order to kill its people and destroy the Indian economy.
The petition submitted that the virus which originated in China’s Wuhan didn’t spread to its other cities like Beijing, Shanghai, Shenzhen, Wenzhou but spread to a thousand kilometers distance to Indian cities and countries.
The petition contended that the virus was very dangerous and aggressive and was manually designed to mutate and spread from person to person quickly.
The petition further contended that the miseries faced by Indian migrant workers, deaths due to the Virus, jobs lost by people, growing poverty, etc. The economic destruction has also been mentioned in the plea. The economic growth of 0.2% for 2020 as suggested by Moody’s, which earlier in March expected it to be 2.5%. The warning given by the WHO regarding the upcoming ill effects on the country was also mentioned.
The petition further submitted that the disastrous impact on the economy due to the national lockdown that the number of poor people who are below the poverty line will increase. Further, it has also been stated that the World Bank has warned India that the pandemic will hit the country very hard.
The petition cited the conclusions of some scientists and experts who say that the virus was released in India by the Chinese agencies.
In accordance with the provisions under the UN Charter, a petition can’t be filed in ICJ by an individual but a State can do so as per Article 93(1) of the UN Charter, therefore petitioner seeks for directions to the Government of India - Union Ministry of Social Justice, Ministry of Health and Family Welfare, and Ministry of Law and Justice to file a case against the People's Republic of China for a compensation of 600 Billion US dollars.
Earlier, the International Council of Jurists (ICJ) and All India Bar Association (AIBA) have moved the United Nations Human Rights Council (UNHRC) seeking compensation from China from where the deadly coronavirus is said to have originated and may be pleased to enquire and direct China and to adequately compensate international community and member states, particularly India, for surreptitiously developing a biological weapon capable of mass destruction of mankind,” the complaint stated.
The ICJ and AIBA accused Beijing of “surreptitiously developing a biological weapon capable of mass destruction.” “It’s a crime against humanity. China has deliberately concealed crucial information about coronavirus,” ICJ Chairman and AIBA president Adish C Aggarwala said.
